THE SPOUSE VISA

 If you are a non -UK national, wishing to apply to join family members in the UK, for a period exceeding 6 months, as a spouse, a fiancé, a partner, a child, parent or relative, you may wish to apply for a family visa. 

You may also be eligible to switch to a family visa in order to stay with you child, fiancé, or partner, if you are currently living in the UK on a different visa . 

There are many variations of a family visa , depending on your relationship with the UK settled person. We are equipped to handle all aspects of family migration and can advise you on your visa application and process. 

The Spouse Visa

Application

This visa allows non-UK nationals to join their partner in the UK. To be

eligible fo this visa, your spouse must be either a British citizen, or a

settled person, living in the UK with indefinite leave to remain.

 

Eligibility Requirements And Leave of Stay: 

 

This visa is for non- UK residents aged 18 years or over, who are

engaged, married, in a civil partnership with, or have been in a

relationship with and have been living with for the past two years (and

can demonstrate this) someone over the age of 18 years, living in the

UK. This is a settlement visa, enabling you to join, live and work in the

UK for up to 30 months (2 years and 6 months), with your British or

settled partner. This visa can be extended for a further 30 months (2

years and 6 months), providing you satisfy the eligibility criteria. You

may apply for a settled status, if you have lived in the UK for a total of

5 years. 

 

Prior to submitting your application, you will need to ensure you can

satisfy the following criteria:

 

 •  The Genuine Relationship Test; You will need to provide proof of

your relationship with your partner, for example, how you met, how

often you see each other, how long you have lived together etc. 

 •  You must also demonstrate that any previous

relationships have ended. This will include any previous relationship

for you as a non-EEA applicant or your partner (your UK sponsor),

whether a previous marriage or unmarried relationship. 

 •  Demonstrate your knowledge of the English Language.

 •  You will also have to provide the required documents to support

your application, have your biometrics taken and depending on your 

country of origin.

 •  You may also need to pass a medical test to show that you do not

 have Tuberculosis (TB). 

 

Your partner, (who acts as your sponsor) will also have to

demonstrate:

 

 •  They have suitable accommodation for themselves, you and any dependents.

 •  They meet the minimum income threshold: Your partner will need

to show that they can financially support you without claiming public

funds. They will be required to earn at least £18,600 before tax.Should

there be any dependent children who are not British, EEA nationals or permanently settled in the UK, your partner will be required to have an

extra £3,800 for the first dependent child. There is a requirement of

an additional £2,400 for each subsequent child.

Other sources of income may be included in this financial criteria

(such as savings over £16,000, pensions, maternity/ paternity/

adoption pay or sick pay.

 

This application may be made within the UK if the applicant is not

trying to enter the UK as a visitor and has already been given leave to

remain in the UK exceeding 6 months.
